Terms and Conditions

Welcome to Win and Swim!

These terms and conditions outline the rules and regulations for the use of Win and Swim’s services, located in the Netherlands and registered with the Netherlands Chamber of Commerce (KVK).

By accessing our services and registering for lessons through the Zwemscore platform, you agree to be bound by these terms and conditions. If you disagree with any part of the terms, you may not access our services.

1. Registration and Booking

  • 1.1 Individuals interested in participating in our swimming lessons must register through the Eversport platform and pay a €5 registration fee. This fee is charged for account creation and adding participants to the system, and is subject to change in the future.
  • 1.2 Win and Swim staff will manually assign participants from the waiting list to their respective classes based on availability and suitability.
  • 1.3 Lessons are booked automatically for a duration of four weeks in advance from the date of registration.

2. Cancellation Policy

  • 2.1 Participants can cancel their lessons via the Eversport platform.
  • 2.2 Cancellations must be made no later than 24 hours before the scheduled start of the lesson. Failure to cancel within this period will result in the participant’s spot being reserved, and the participant will be charged for the lesson.
  • 2.3 Cancelling membership requires written notice. Specific details on the process and notice period will be provided upon request.

3. Payment

  • 3.1 Payments are due at the end of each month, based on the number of lessons attended. Participants will be charged a registration fee upon signing up, regardless of attendance.
  • 3.2 Participants will receive an email with an iDeal link for payment. It is the participant’s responsibility to ensure timely payment.

4. Communication and Changes

  • 4.1 Win and Swim will communicate any lesson cancellations or significant changes via email or direct contact, aiming to provide advance notice whenever possible.
  • 4.2 Changes in coaching staff or lesson schedules will be communicated to participants in a timely manner.

5. Conduct and Liability

  • 5.1 Participants are expected to adhere to the rules of the swimming pool and conduct themselves appropriately at all times.
  • 5.2 Win and Swim is not responsible for lost or damaged personal items, including jewelry. It is recommended not to wear jewelry during swimming activities.
  • 5.3 Win and Swim may occasionally take photos or videos for marketing purposes. All participants will be asked for their consent prior to any such activities.

6. Amendments

  • 6.1 Win and Swim reserves the right to amend these terms and conditions at any time. Participants will be notified of any changes via email.

8. Governing Law. 

  • These terms and conditions are governed by and construed in accordance with the laws of the Netherlands, and you submit to the exclusive jurisdiction of the courts located in the Netherlands for the resolution of any disputes.
